Terms & Conditions

1. General
   1.1. I reserve the right to refuse a commission for any reason.
   1.2. Commissions are for personal use, unless agreed otherwise.
   1.3. The prices listed on this page are start-off points and not a final quote.
   1.4. You get 3 free revisions, one for each stage (1 revision at the sketch stage, 1 for the colored sketch midway point, 1 minor revision on the finished art).
   1.5. Major changes and additional revisions incur additional fees, unless there has been a misunderstanding or error on my end.
   1.6. You will receive the finished piece in the file format and size you’ve requested, alongside a watermarked export that can be used for social media uploads.
   1.7. Proper credit and tagging need to be given every time and on every platform/print run.
   1.8. Deadlines are agreed upon before beginning any work, and they will be included in the contract. My work week is from Monday to Friday. Rush fees range from +50% to 100%, depending on my availability. 
   1.9. The use of any of my works (commissions, sketches, images, photos, videos, anything) for non-fungible tokens (NFTs), blockchains, cryptocurrency, or for training, feeding, modifying, referencing, or generating using any AI (Artificial Intelligence) platforms, apps, or services is strictly prohibited.
   1.10. All artwork will be digital. Other arrangements incur additional fees.
   
   
2. Payment
   2.1. Payments will be in Euros. 
   2.2. Payments can be made via:
   – Bank Transfer;
   – VGen;
   – Stripe;
   – Revolut.
   2.3. Payments are either 50% upfront and 50% before the final high-resolution non-watermarked files are sent, or 100% upfront.
   2.4. Indie authors receive special commercial fee rates. Please reach out if applicable.
   2.5. For all other forms of commercial work (book boxes, special editions, etc.), a license fee of up to 150% will be included, depending on usage (online marketing, prints, merchandise, dust jackets, etc.).
   
   
3. Copyright
   3.1. I, Magdalena Chervenyakova, remain the sole copyright holder.
   3.2. I reserve the right to showcase any commissioned artwork as portfolio/example pieces. Should you require a delay in my uploading online, do let me know.
   3.3. The work may not be altered, cropped, or misrepresented unless agreed otherwise. Please let me know any export requirements you may have before beginning work to avoid this.
   
   
4. Cancellation & Refund Policy
   4.1. In case of a cancellation, you will lose the right to use any work already created (sketches, completed files, etc.). I retain the right to alter the files and offer them for sale.
   4.2. In case of a cancellation:
   – Before the start date: you will receive a full refund;
   – At the 50% mark: I retain 50% of the full quote;
   – After the 50% mark: you will not be entitled to a refund. 
   4.3. If applicable, the commercial fee will be deducted as well.
   4.4. If I cancel the commission, you will receive a full refund.
